1. About these terms

These Terms and Conditions apply to your access to and use of the MotifyMe® website, platform, account features, free trial, reminder services, subscriptions, vehicle record tools, document storage, exports, transfer features, finance enquiry routes, business and fleet enquiry routes and related services we make available from time to time.

By using our website or services, or by creating an account, you agree to these terms. If you do not agree, you should not use MotifyMe®.

If you use MotifyMe® on behalf of a business, organisation or any third party, you confirm that you have the authority to bind that business, organisation or third party to these terms.

We may add, change, improve, suspend or remove features from time to time. Some features may only be available on certain plans, to certain users or for certain vehicles.

4. Accounts and eligibility

You must provide accurate information when creating an account or using our services. You are responsible for keeping your login credentials secure and for all activity on your account unless caused by our failure to maintain reasonable security measures.

You must update your details if they become inaccurate or outdated.

We may refuse registration, reclaim usernames or restrict account access where reasonably necessary for operational, legal, security or brand protection reasons.

5. Plans, pricing and plan scope

Prices are stated in GBP. Any taxes or charges will be shown during checkout where applicable. Where available, the 14 day free trial comes first and the subscription starts after the trial ends.

The standard self-serve plans available on the website are Single Vehicle and Multi Vehicle. If you have more than three vehicles, operate as a business or fleet, or need a broader or more tailored setup, you should contact hello@motifyme.co to discuss a bespoke arrangement.

6. Subscriptions and billing

  • Our standard plans currently begin with a 14 day free trial where stated on the website.
  • No card details are required upfront to begin the trial.
  • If you continue after the trial, the selected paid plan becomes a recurring subscription unless clearly stated otherwise.
  • Your subscription starts after the trial ends.
  • You authorise us and our payment providers to charge the subscription fee and any applicable taxes using your chosen payment method once billing begins.
  • Your subscription renews automatically at the end of each billing cycle unless you cancel before renewal.
  • You can cancel at any time. Unless we state otherwise, cancellation stops future renewals and your paid access continues until the end of the current paid billing period.
  • During the remainder of your billing cycle after cancellation, you may still be able to log in, download records, export PDFs or transfer your Vehicle Story where those features are available.
  • Subscription fees are generally non-refundable once a paid billing period has started, except where required by law or where we expressly agree otherwise.
  • If payment fails after the trial or during an active subscription, we may retry collection, restrict features, downgrade access or suspend the account until payment is successfully made or the subscription is cancelled.
  • We may change prices, plans or billing structures in the future. Where changes affect an existing subscription, we will aim to give reasonable advance notice before the change takes effect.

Consumer rights: Nothing in these terms limits any non-excludable rights you have under applicable consumer law.

7. Reminders and notifications

MotifyMe® may send reminders, notifications and service-related messages relating to MOT, tax, insurance, servicing, free trial status, account status, subscriptions, security or other operational matters.

You are responsible for checking official due dates and legal requirements yourself. Reminders are intended to assist you, but they do not replace your own responsibility to ensure that your vehicle remains taxed, insured, roadworthy and compliant.

8. Acceptable use

You must not misuse MotifyMe®. In particular, you must not:

  • use the service for any unlawful, fraudulent or misleading purpose;
  • upload, store or share content that is defamatory, obscene, abusive, infringing, malicious or otherwise unlawful;
  • attempt to gain unauthorised access to accounts, systems, code or data;
  • probe, scan or test the vulnerability of the service except with our written permission;
  • interfere with the operation, security or performance of the website or platform;
  • copy, scrape, reverse engineer, decompile or exploit the service except to the extent such restriction is prohibited by law;
  • use automated tools to access the platform in a way that creates excessive load, bypasses restrictions or extracts material at scale;
  • impersonate another person or falsely suggest an affiliation with us or a partner;
  • use the platform in a way that could damage our reputation, brand, systems or other users.

9. Vehicle records, uploads and user content

You remain responsible for the information, files, documents, photographs, notes and other content that you upload, store, submit or transfer through MotifyMe®.

You confirm that you have the right to upload and use that content and that doing so does not infringe another person's rights or break any law.

You should review your uploaded records carefully and keep your own backups of important documents. Although we use reasonable measures to operate the platform responsibly, no digital storage system is entirely free from risk.

Licence you give us

To operate the service, you grant us a non-exclusive, revocable, limited licence to host, store, process, reproduce, format, transmit and display your content only as reasonably necessary to provide and improve the service, support account functions, generate outputs you request, maintain security, comply with law and administer record transfers initiated by you.

10. Vehicle Story transfers

Where the feature is available, you may transfer a Vehicle Story and associated uploaded attachments to a buyer or new owner.

You are responsible for checking the content before transfer and removing anything you do not wish to share. Once a transfer has been accepted or completed, the recipient controls their copy of the transferred data and the transfer may not be reversible.

Important: Do not include identity documents, payment details or unnecessary personal information in a Vehicle Story unless you are comfortable sharing them with the recipient.

11. Valuations, resale support and informational content

Vehicle valuations, mileage-based estimates, market indications, resale support content, prompts, summaries and similar outputs are provided for general information only.

  • They are not financial advice.
  • They are not insurance valuations.
  • They are not regulated investment, credit or broking advice.
  • They are not guarantees of sale price, market value, trade-in value or lender acceptance.
  • They should not be relied on as the sole basis for a purchase, sale, finance, insurance or legal decision.

Actual vehicle values depend on multiple factors including condition, history, mileage, location, specification, documentation, market demand and third-party decisions.

12. Finance enquiries and Presto Finance

MotifyMe® may offer finance enquiry routes, a vehicle finance calculator and business or fleet finance discussion routes on its website. Where this is available, MotifyMe® Ltd acts as an introducer only.

MotifyMe® does not provide financial advice, does not conclude finance agreements, does not negotiate credit terms, does not arrange regulated credit and does not handle client money.

Finance calculator

The vehicle finance calculator is provided for illustration only. It is not a finance offer, quotation, guarantee or credit decision, and it does not guarantee eligibility, approval or rate.

Soft search and hard search

Where an initial finance application is made through the relevant route, it may begin with a soft search that does not affect your credit score. If you decide to proceed with a lender, a hard search may then be completed.

Finance terms and lender decision-making

Any finance is subject to status, affordability, lender criteria and lender terms. Any finance product, lender decision, finance agreement or related regulated activity is separate from your MotifyMe® subscription and is governed by the terms and disclosures provided by the relevant finance party.

Business and fleet finance discussions

If you contact MotifyMe® about finance for multiple vehicles, vans, business vehicles or fleet requirements, MotifyMe® will discuss your enquiry as an introducer only and may pass your details to Presto Finance Ltd or relevant service providers supporting that enquiry flow.

If you submit a finance enquiry through our website, you agree that your enquiry details and associated attribution data may be passed to Presto Finance Ltd and relevant service providers supporting that enquiry flow.

Separate relationship: Any finance product, lender decision, finance agreement or related regulated activity is separate from your MotifyMe® subscription and is governed by the terms and disclosures provided by the relevant finance party.

13. Third-party services and links

Some parts of MotifyMe® may depend on or link to third-party tools, payment providers, analytics services, document handlers, referral systems, communications providers or partner websites. We are not responsible for third-party products or services that we do not control, although we may integrate with them or refer you to them.

Your use of third-party services may also be subject to that third party's own terms and privacy policy.

14. Intellectual property

All intellectual property rights in the MotifyMe® website, platform, branding, software, design, layout, copy, graphics, databases and service materials are owned by or licensed to MotifyMe® Ltd unless otherwise stated.

These terms do not transfer ownership of any intellectual property to you. We grant you a limited, non-exclusive, non-transferable, revocable right to access and use the service for its intended purpose in accordance with these terms.

MotifyMe® and Your Vehicle's Story. Made Smart.® are protected brand assets and must not be used without permission except where lawful fair reference applies.

15. Service availability, maintenance and changes

We aim to keep MotifyMe® available and functioning properly, but we do not guarantee uninterrupted or error-free availability.

  • We may carry out maintenance, updates, upgrades, fixes or security work at any time.
  • We may change functionality, design, data sources, workflows or integrations to improve the service, meet legal requirements or respond to operational needs.
  • We may suspend or restrict access where reasonably necessary for maintenance, security, abuse prevention, regulatory reasons or system integrity.
  • The Fuel Finder feature relies on live third-party fuel price data. We do not guarantee the accuracy, completeness or availability of that data at all times. Fuel prices shown are for guidance only and may vary at the pump.

16. Business continuity and service closure

If we decide to discontinue all or a material part of the MotifyMe® service, we will aim to give reasonable notice where practicable.

During any closure or transition period, we will aim to allow users a reasonable opportunity to export or access their vehicle records, subject to technical, legal and security constraints.

Any handling, deletion or retention of personal data during closure will remain subject to our Privacy Policy and applicable legal obligations.

17. Liability and disclaimers

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or breach of rights that cannot legally be excluded.

Subject to that:

  • the service is provided on an "as available" basis;
  • we do not guarantee that reminders, data feeds, valuations, exports, finance calculator outputs or integrations will always be complete, accurate, current or uninterrupted;
  • you are responsible for checking official records, legal deadlines, insurance requirements, MOT status, tax position and vehicle information independently;
  • we are not liable for indirect, incidental, special or consequential loss, loss of profits, loss of opportunity, loss of goodwill or loss of data, except where the law does not allow that exclusion;
  • to the fullest extent permitted by law, our total aggregate liability arising out of or in connection with MotifyMe® will be limited to the amount you paid us in the 12 months before the event giving rise to the claim, or £100 if higher.

18. Privacy and data protection

Your use of MotifyMe® is also subject to our Privacy Policy, which explains how we collect, use, store and share personal data, including finance enquiry data, business and fleet enquiry data, attribution data and cookies, analytics and tracking technologies.

19. Termination, suspension and account closure

You may stop using MotifyMe® at any time and may cancel your subscription in line with these terms.

We may suspend, restrict or terminate your account or access immediately, with or without notice, if we reasonably believe that:

  • you have breached these terms;
  • your use presents a security, fraud, legal or reputational risk;
  • we are required to do so by law, regulation or a competent authority;
  • payment remains overdue or repeatedly fails;
  • continued service is not commercially or technically viable.

Termination or suspension does not affect rights or obligations that accrued before the termination date, including any payment obligations or legal rights to retain records where necessary.

21. General legal terms

  • If any part of these terms is found to be invalid or unenforceable, the rest will continue in force.
  • If we delay enforcing any right, that does not mean we waive it.
  • We may update these terms from time to time. The updated version will apply from the date posted, unless a different effective date is stated.
  • You may not assign or transfer your rights under these terms without our consent, except where the law allows it.
  • We may transfer our rights and obligations where reasonably necessary as part of a reorganisation, sale, investment, merger or business restructure, provided this does not reduce any mandatory consumer protections you have.
  • These terms are governed by the laws of England and Wales.

22. Jurisdiction

If you are a consumer resident in the United Kingdom, you may bring proceedings in the courts that the law allows for your residence. Otherwise, the courts of England and Wales will have exclusive jurisdiction, unless applicable law says otherwise.
